Terms of Service

These Terms of Service ("Terms") are an agreement between you and ShiftlyAI Ltd ("Shiftly", "we", "us"), a company registered in England and Wales under company number 17248938, and govern your use of the Shiftly WhatsApp shift assistant and website at getshiftly.co.uk. By using Shiftly, you agree to these Terms. If you don't agree, please don't use the service.
1. The service
Shiftly helps you manage your work schedule over WhatsApp: you send a photo of your roster and we read it and keep your calendar up to date, with reminders, leave, swaps and related scheduling help. Features may change, be added, or be removed as the product develops.
2. Eligibility
You must be at least 18 years old and able to enter into a contract to use Shiftly. You're responsible for the WhatsApp account and phone number you use with us.
3. Beta and pricing
Shiftly is currently free while in beta. We may introduce paid plans in future; if we do, we'll tell you before any charges apply, and paid features will be clearly identified.
4. Accuracy — please check your roster
Shiftly uses AI to read rosters and can make mistakes. It is a convenience tool, not an official source of your duties. You remain responsible for confirming your actual shifts, sign-on times and duties with your employer's official roster. Do not rely on Shiftly alone for safety-critical or attendance decisions. Always verify against your Train Operating Company's official roster or booking-on system.
5. Your responsibilities
- Give accurate information and keep your details up to date.
- Use Shiftly only for your own lawful scheduling purposes.
- Don't misuse the service — no attempts to disrupt, reverse-engineer, overload, or gain unauthorised access, and no uploading of unlawful content.
- Don't upload other people's personal data without a lawful basis to do so.
6. Third-party services
Shiftly works with third-party services including WhatsApp (Meta), Google Calendar and Apple Calendar. Your use of those services is subject to their own terms and privacy policies, which we don't control.
7. Intellectual property
Shiftly and its content, branding and software are owned by us or our licensors. These Terms don't transfer any of those rights to you. Your roster and schedule data remain yours; you grant us the permissions needed to provide the service to you.
8. Availability and "as is"
We work to keep Shiftly reliable, but it's provided on an "as is" and "as available" basis, without warranties of any kind. We don't guarantee that it will be uninterrupted, error-free, or that every roster will be read correctly. Message delivery also depends on WhatsApp and your network.
9. Limitation of liability
To the fullest extent permitted by law, Shiftly is not liable for any indirect or consequential loss, or for any loss arising from missed shifts, incorrect calendar entries, missed reminders, or reliance on information provided by the service. Nothing in these Terms limits liability that cannot be limited by law (such as for death or personal injury caused by negligence, or fraud).
10. Suspension and termination
You can stop using Shiftly at any time and delete your data by messaging "delete my account". We may suspend or end your access if you breach these Terms or misuse the service.
11. Changes to these Terms
We may update these Terms from time to time. We'll update the "Last updated" date above and, for significant changes, let you know in WhatsApp. Continuing to use Shiftly after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, subject to any mandatory rights you have as a consumer.
